Terms of Service

These terms are an agreement between you and Outshine Fitness LLC (“Outshine”). Because Outshine is for ages 13–17, a parent or legal guardian must review and agree to these terms with the athlete. By creating an account or using the app, you and your parent/guardian agree to these terms.

Who can use Outshine & parental agreement

Outshine is for athletes ages 13 and older. You must be at least 13 to create an account. If you are under 18, a parent or legal guardian must read and accept these terms on your behalf; that parent/guardian is the contracting party, agrees to these terms, and is responsible for the account, its use, and any Pro payments. Where state law requires it (including Florida), account creation for the youngest minors may require verified parental consent or may not be permitted — see “Florida users” below. You agree to provide accurate information, including your date of birth.

Florida users

Florida law (HB 3) restricts social-media accounts for minors. Where it applies, users under 14 may not hold an account, and users who are 14 or 15 may hold an account only with verified parental consent. A parent or guardian may request termination of a minor's account, and we will honor it. We apply these rules to Florida residents as required by law.

Your account

Keep your login credentials secure and don't share your account. You're responsible for activity under your account. Tell us right away if you suspect unauthorized access.

Community rules

Outshine is about real-world activity and positive connection. You agree not to:

  • Harass, bully, threaten, or harm other people.
  • Post sexual, violent, hateful, or otherwise inappropriate content, or anything that endangers a minor.
  • Impersonate others or create fake accounts.
  • Spam, scam, or solicit users off-platform.
  • Share others' private information, or break the law.

Meeting in person: games and meetups happen in the real world. Use good judgment, meet in public places, and involve a trusted adult. Outshine does not vet users and is not responsible for offline interactions.

Safety & moderation

You can report or block other users and content. We may review reports and, at our discretion, remove content, hide posts, cancel events, or suspend or ban accounts that violate these terms or threaten user safety.

Your content

You keep ownership of the content you create. You grant Outshine a non-exclusive, worldwide, royalty-free license to host, store, display, and use it as needed to operate and improve the service. Don't post content you don't have the right to share.

Copyright & DMCA

We respect intellectual property and respond to valid notices under the Digital Millennium Copyright Act. If you believe content on Outshine infringes your copyright, send a notice with the required details (identification of the work and the material, your contact info, a good-faith statement, and your signature) to our designated agent: [email protected], Outshine Fitness LLC, Orlando, FL. We will remove infringing material, provide a counter-notice process, and terminate repeat infringers' accounts.

Health, fitness & AI disclaimer

Outshine provides activity tracking and general fitness information, including AI-generated suggestions. It is not medical, dietary, or professional training advice. AI output may be inaccurate or incomplete — use judgment and don't rely on it as advice. Always listen to your body and consult a doctor before starting or changing a fitness routine.

Assumption of risk

Physical activity carries inherent risks, and games/meetups happen in the real world among people we do not vet. You participate in activities and any in-person meetups at your own risk, and a parent/guardian accepts these risks on a minor's behalf.

Outshine Pro & automatic renewal

Pro is an optional paid subscription billed through Stripe. It is an automatically renewing subscription: the plan renews and your payment method is charged each billing period (e.g., monthly) at the then-current price until you cancel. You can cancel anytime through the in-app billing portal and keep access through the end of the current period — cancellation is online and takes only a few steps. We'll send a renewal reminder at least annually and notice of any material price or term change. Except where required by law, payments are non-refundable. By subscribing, the paying adult gives express consent to these recurring charges.

Third-party services

Outshine relies on providers like Supabase, Netlify, Mapbox, Stripe, Anthropic, and Resend. Your use of related features may also be subject to their terms.

Termination & account deletion

You can stop using Outshine and delete your account at any time from the app or by contacting us; we delete associated data as described in our Privacy Policy. We may suspend or terminate accounts that violate these terms or to protect the community.

Disclaimers & limitation of liability

Outshine is provided “as is,” without warranties of any kind. To the maximum extent permitted by law, Outshine Fitness LLC is not liable for indirect, incidental, or consequential damages, or for offline interactions between users, and our total liability is limited to the greater of the amount you paid us in the prior 12 months or US $100. Some protections cannot be limited for minors or for personal injury under applicable law, and nothing here limits rights that cannot be waived.

Indemnification

To the extent permitted by law, you (and, for a minor, the accepting parent/guardian) agree to indemnify Outshine for claims arising from your content, your use of the service, or your violation of these terms.

Dispute resolution & arbitration

Most concerns can be resolved by emailing us first. Otherwise, you (or the accepting parent/guardian) and Outshine agree to resolve disputes through binding individual arbitration rather than in court, and to waive jury trials and class actions, to the extent permitted by law. You may opt out of this arbitration agreement by emailing [email protected] within 30 days of first accepting these terms. This section does not apply to claims that cannot be arbitrated under applicable law.

Governing law & venue; severability

These terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules, and disputes not in arbitration will be heard in the state or federal courts located in Orange County, Florida. This choice of law does not deprive you of mandatory consumer protections of your home state. If any provision is found unenforceable, the rest remain in effect.

Changes

We may update these terms and will revise the date above and give notice of material changes. Continued use after changes means you accept the updated terms.
